Memorandum of Understanding:

addendum to the Lusaka Protocol for the cessation of hostilities and the resolution of the outstanding military issues under the Lusaka Protocol

Preamble

The Delegation of the Angolan Armed Forces, mandated by the Government of the Republic of Angola;

The Delegation of the UNITA Military Forces, mandated by its Leadership Commission;

In the presence of the United Nations in Angola and of the Observer States of the Angolan Peace Process;

Considering that the Lusaka Protocol, signed on 20/11/94 by the Government and by UNITA, with United Nations mediation and in the presence of the Observer States of the Angolan Peace Process, the legal and political instrument for the resolution of the Angolan conflict, in the sense of securing peace and national reconciliation in the Republic of Angola, was unable to experience the positive evolution expected for its definitive conclusion;

Considering that, the growing and pressing need to secure peace and national reconciliation in the Republic of Angola, expressed and felt daily by all Angolans, has become imperative and urgent, and calls first of all for the cessation of the armed conflict between UNITA, as a political and military structure, and the Government, promoting, to this end, appropriate initiatives with creativity and flexibility, for the definitive conclusion of the implementation of the Lusaka Protocol;

Conscious of the fact that, the end of the internal conflict leads to peace and national reconciliation in the Republic of Angola and constitutes a challenge for which a determined commitment needs to be made to overcome and achieve for the benefit of the Angolan people;

Accordingly, in order to implement their commitments and obligations under the Lusaka Protocol, hereby decide to adopt the Memorandum of Understanding, in the following terms:

Chapter I: Object and principles of the Memorandum of Understanding

1. Object

1.1. The object of the Memorandum of Understanding is the commitment by the parties to, through their fraternal and active cooperation, guarantee the attainment and materialization of the ceasefire and the resolution of all pending military issues and, subsequently, the definitive resolution of the armed conflict, resumed following the total execution of the task of the formation of the FAA, under the Lusaka Protocol.

1.2. The objective of the cooperation between the parties is the resolution of the negative military factors which gave rise to the blockade of the Lusaka Protocol and, subsequently, the creation of conditions for its definitive conclusion.

2. Fundamental principles

2.1. The parties reaffirm their respect for the rule of law and fora the democratic institutions in the Republic of Angola, and, accordingly, the observance of the Constitutional Law and of the remaining legislation in force in the Republic of Angola.

2.2. The parties reiterate their unequivocal acceptance of the validity of the relevant legal and political instruments, in particular, the Lusaka Protocol and the Resolutions of the Security Council of the United Nations, relative to the Angolan peace process.

2.3. The parties recognize that the respect for democracy in all fields and levels of national life is essential for peace and national reconciliation.

Chapter II: Agenda of the Memorandum of Understanding

1. General points

1.1. In order to materialize their commitments and obligations under the Lusaka Protocol, the parties accept as the agenda of work for the Military Talks, the following:

I. Issues of National Reconciliation

II. Cessation of hostilities and pending military issues under the Lusaka Protocol

a) Ceasefire

b) Disengagement, quartering and conclusion of the demilitarization of the UNITA military forces

c) Integration of Generals, Senior Officers, Captains and Junior Officers, Sergeants and men from the UNITA military forces into the Angolan Armed Forces, in accordance with the existing structural vacancies

d) Integration of Generals and Senior Officers from the UNITA military forces into the National Police, in accordance with the existing structural vacancies

e) Demobilization of the excess personnel from the UNITA military forces and the extinction of the UNITA military forces

f) Vocational reintegration of demobilized personnel of the ex-UNITA military forces into national life

III. Institutional Issues

a) Institutional structure for the coordination of the Understanding

b) Time table for the application of the Understanding

c) Signature of the Understanding

1.2. In order to materialize their commitments and obligations under the Lusaka Protocol, the parties accept as conclusions of the agenda of Military Talks, those described in the points listed below.

2. Issues of National Reconciliation

(Sole paragraph) Amnesty

2.1. The Government guarantees, in the interest of peace and national reconciliation, the approval and publication, by the competent organs and institutions of the State of the Republic of Angola, of an Amnesty Law for all crimes committed within the framework of the armed conflict between the UNITA military forces and the Government.

3. Cessation of hostilities and pending military issues under the Lusaka Protocol

A) Ceasefire

3.1. The parties reiterate their commitment to comply scrupulously with all their commitments and obligations relative to the task of re-establishment of ceasefire (in the spirit envisaged in Annex 3, of Item I.1 of the Agenda of Work - Military Issues I of the Lusaka Protocol).

3.2. In this regard, the Government, through the General Staff of the FAA and the UNITA military forces, through the High General Staff, will issue and comply with a declaration of re-establishment of the ceasefire, with a view to ending the armed conflict, and the attainment of peace and national reconciliation.

3.3. The task of re-establishing the ceasefire, includes the following:

a) The definitive and total cessation of military actions throughout the national territory and the non-dissemination of hostile propaganda.

b) The non-conduct of force movements, to reinforce or occupy new military positions, as well as the non undertaking of acts of violence against the civilian populations and the destruction of property.

c) The regular reporting on the situation of positions of the units and the other paramilitary structures of the UNITA military forces in zones or areas of possible military tension.

d) The guarantee of protection of persons and their property, of public resources and property, and also of the free circulation of persons and goods.

B) Disengagement, quartering and conclusion of the demilitarization of UNITA military forces

3.4. The parties reiterate their commitment to comply scrupulously with their commitments and obligations relative to the task of quartering and conclusion of the demilitarization of the UNITA military forces (in the spirit envisaged in Annex 3 of Item II.1 of the Agenda of Work – Military Issues I of the Lusaka Protocol).

3.5. In this regard, the Mixed Military Commission, with the support of the General Staff of FAA, will proceed to quarter and demilitarize all units and paramilitary structures of the UNITA military forces, including the following:

a) The reporting, by the High General Staff of the UNITA military forces, to the Mixed Military Commission, on all reliable and verifiable data, relative to the combative and numerical composition of the units and paramilitary structures of the UNITA military forces, and their location.

b) The establishment of monitoring mechanisms of the demilitarization process of the UNITA military forces.

c) The identification of the units and the paramilitary structures of the UNITA military forces, the establishment of quartering areas for the same.

d) The definition of the respective itineraries and means of movement and the conduct of the military units and paramilitary structures of the UNITA military forces to quartering areas.

e) The disengagement from the points of location and the movement of the units and paramilitary structures of the UNITA military forces to quartering areas.

f) The reception, accommodation and feeding, and the registration of the personnel of the military units and paramilitary structures of the UNITA military forces in the quartering areas.

g) The handing over and, in continuation, the collection, storage and subsequent destruction of the entire armament and equipment of the military units and paramilitary structures of the UNITA armed forces.

C) Integration of Generals, Senior Officers, Captains and Junior Officers, Sergeants and men, from the UNITA military forces into the Angolan Armed Forces

3.6. The Government, in the interest of national reconciliation, will proceed, through the General Staff of FAA, to integrate the Generals, Senior Officers, Captains and Junior Officers, Sergeants and men from the UNITA military forces into the FAA, in accordance with the existing structural vacancies.

3.7. In this regard, the process of integration of Generals and Senior Officers, Captains and Junior Officers, Sergeants and men from UNITA military forces, will include the following:

a) The incorporation into FAA and the commissioning of Generals, Senior Officers, Captains and Junior Officers, Sergeants and men from the UNITA military forces, in accordance with the existing structural vacancies.

b) The training and commissioning of Generals, Senior Officers, Captains and Junior Officers, Sergeants and men from the UNITA military forces.

D) Integration of Generals and Senior Officers from the UNITA military forces into the National Police

3.8. The Government, in the interest of national reconciliation, will proceed to integrate some Generals and Senior Officers from the UNITA military forces into the National Police, through the General Command of the National Police, in accordance with the existing structural vacancies.

3.9. In this regard, the process of integration of Generals and Senior Officers of the UNITA military forces into the National Police, includes the following:

a) Incorporation into the National Police and the commissioning of Sub-Commissioners and Senior Officers from the UNITA military forces shall be in accordance with the existing structural vacancies.

b) The training and assumption of duties of Sub-Commissioners and Senior Officers from the UNITA military forces.

E) Demobilization of the personnel of the UNITA military forces and the extinction of the UNITA military forces

3.10. The parties reiterate their commitment to comply scrupulously with their commitments and obligations relative to the task of demobilization of the excess personnel of the UNITA military forces and the extinction of the UNITA military forces (in the spirit envisaged in Annex 4, Item II.1 of the Agenda of Work - Military Issues II of the Lusaka Protocol).

3.11. In this regard, the Mixed Military Commission, with the support of the United Nations, shall proceed to demobilize the excess personnel of the UNITA military forces and the extinction of the UNITA military forces, including the following;

a) The individual demobilization of the excess personnel from the UNITA military forces.

b) The formal and definitive extinction of the UNITA military forces.

c) The placement of the demobilized personnel of the ex-UNITA military forces at the administrative dependency on the General Staff of FAA, through the FAA Military Regions and Operational Commands.

F) Social and vocational reintegration of demobilized personnel of the ex-UNITA military forces into national life

3.12. The parties reiterate their commitment to comply scrupulously with their commitments and obligations relative to task of social reintegration of the demobilized personnel (in the spirit envisaged in Annex 4, Item II.1 of the Agenda of Work - Military Issues II of the Lusaka Protocol).

3.13. In this regard, the Government through the General Staff of FAA and of the competent public organs and services, with UNITA participation and with the assistance of the international community, shall proceed with the reintegration of the demobilized personnel into civil society, within a program of vocational reintegration.

3.14. The vocational reinsertion of the demobilized personnel of the ex-UNITA military forces includes the following:

a) The protection, accommodation and feeding of the personnel of the ex-UNITA military forces in the training centers.

b) The professional training of the personnel of the ex-UNITA military forces, to capacitate them for the national labor market, through a program of special and urgent social reintegration.

Chapter III: Coordination and application of the Memorandum of Understanding

1. Coordination of the Memorandum of Understanding

1.1. The institutional structures of coordination of the Memorandum of Understanding are as follows:

a) Mixed Military Commission

b) Technical Group

1.2. The Mixed Military Commission will have the following composition, functions and rules of operation:

a) Composition and Management:

a.1. Executive Member and President of the Mixed Military Commission:

The Military Representative of the Government

a.2. Executive Member of the Mixed Military Commission:

Military Representative of the UNITA Military Forces

a.3. Permanent Observers of the Mixed Military Commission:

The Military Representative of the United Nations

The Military Representative of the United States of America

The Military Representative of Russia

The Military Representative of Portugal

b) Functions

b.1. To assist the Mixed Military Commission in the performance of its duties.

b.2. To see to the application of the provisions of the Memorandum of Understanding.

b.3. To organize ad hoc meetings of the military experts to study the causes of possible difficulties which may block the effective execution of the Memorandum of Understanding or other issues considered to be of interest by the Mixed Military Commission.

b.4. To draw up a detailed time table and the definition of activities to be executed as part of the application of the Memorandum of Understanding.

c) Rules of operation:

c.1. To meet, periodically, to prepare the meetings of the Mixed Military Commission and, extraordinarily, to analyse issues emanating from the Mixed Military Commission or, any time such a meeting is deemed necessary.

c.2. At the regional level, to meet daily under the chairmanship of a military expert from the Angolan Armed Forces.

2. Timetable of application of the Memorandum of Understanding

2.1 For the materialization of the Memorandum of Understanding, the Angolan Armed Forces and the UNITA Military Forces pledge to comply with the following implementation time table:

2. Interpretation

2.1. Differences of interpretation of application of the Memorandum of Understanding shall be submitted to the Mixed Military Commission for resolution, in a spirit of friendship, tolerance and understanding.

3. Entry into force of the Memorandum of Understanding

3.1. The Memorandum of Understanding shall come into effect after its signing by the parties.

4. Signing of the Memorandum of Understanding

4.1. The parties hereby sign the Memorandum of Understanding, agreeing to be bound by it, accepting and undertaking to implement, in good faith, compulsorily and fully, all its provisions.

Annex I: to the Memorandum of Understanding Addendum to the Lusaka Protocol for the Cessation of Hostilities and the Resolution of the Outstanding Military Issues under the Lusaka Protocol

Document relating to the quartering of the UNITA Military Forces

The Delegation of the Angolan Armed Forces and the Delegation of the UNITA military Forces to the Military Talks, pertaining to the quartering of the UNITA military forces, have agreed as follows:

1. General points on the quartering

(i) The quartering of the UNITA military forces must provide the living conditions necessary for the stay of the military in a total number of up to 50,000, comprising about 12 General and 47 Brigadiers, about 1,700 Senior Officers, about 17,350 Captains and Junior Officers, about 3,150 Sergeants and about 27,740 men, for the duration of a period of time from the welcoming of the personnel until their integration into FAA and the National Police and the vocation reinsertion of the demobilized personnel.

(ii) Quartering areas must have a structure of operation managed by highly qualified personnel, with capacity to quarter up to 1,600 personnel and with security and easy access.

(iii) The quartering of the UNITA military forces implies, also, on the one hand, the accommodation of 12 Generals and 47 Brigadiers, in cities close to the quartering areas and, on the other hand, the organization and securing of areas for the accommodation of the families of the military, close to the quartering areas, in a total of up to 300,000 individuals, including men, women and children.

(iv) Ensuring emergency initial assistance to the families of the military of the UNITA military forces, and the promotion of their reintegration, supported by small-scale productive ventures and provision of services, that is to say, quick income generating projects in the areas of agriculture, rural commerce and other possible areas of profitable occupation, to be guaranteed by the competent organs and entities of State administration, in close cooperation with the General Staff of FAA and with the participation of the United Nations.

2. Structure of the Quartering Area

(i) The quartering area shall have the following structure:

Leadership of the quartering area shall consist of the Chief, Deputy Chief, Officer for civic education, personnel officer, armament officer, communications officer, to be appointed from among the quartered personnel by the High General Staff of the UNITA military forces.

Support and services group, comprising the guards and garrison, radio station, medical post, kitchen and mess hall and transportation section, to be appointed from among the quartered personnel by the High General Staff of the UNITA military forces.

Up to 16 companies of personnel quartered, in a composition of 100 personnel per company.

(ii) The Chief of the quartering area shall report to the Chief of the Working Team of the General Staff and, will be responsible for the operation and discipline of the quartering area.

3. Management of the Quartering Area

(i) The management of the quartering areas shall be conducted by the General Staff of FAA, through a working team headed by a General of FAA from the UNITA military forces, with the cooperation of the United Nations, which shall provide technical assistance to the organization and management, and also material support.

(ii) The localities for the accommodation of the families of the military of the UNITA military forces shall be materially ensured and managed administratively by the competent organs of State Administration, in close cooperation with the General Staff of FAA and with the participation of the United Nations, which shall provide assistance to the organization and management, as well as material support.

4. Location of the Quartering Areas

(i) For the personnel of the UNITA military forces of COpE North:

Madimba, in Madimba commune, M?Banza Congo municipality, Zaire province;

Vale do Loge, in Vale do Loge commune, Bembe municipality, Uige province;

Wamba, in Wamba commune, Sanza Pombo municipality, Uige province;

Cabeza, in Quiage commune, Quibaxi municipality, Bengo province.

(ii) For the personnel of the UNITA military forces of COpE North-east:

Capaia, Capaia commune, Lucapa municipality, Lunda Norte province;

Damba Penitenciaria, Catala commune, Caculama municipality, Malange

province;

Ganga Sol, Quissole commune, Malange municipality, Malange province;

Chinege, Muriege commune, Muconda municipality, Lunda Sul province;

N’Guimbi, Xá-Muteba commune, Xá-Muteba municipality, Lunda Norte province.

(iii) For the personnel of the UNITA military forces of COpE Centre:

Gando, Cambandua commune, Kuito municipality, Bié province;

Document relating to the quartering disarming and repatriation of foreign military forces within the areas of the national territory under control of UNITA Military Forces

The Delegation of the Angolan Armed Forces and the Delegation of the UNITA military forces, in the matter concerning the quartering, disarming and repatriation of foreign military forces in areas of the national territory under control of the UNITA military forces, agree as follows:

1.1. The parties recognize the existence of foreign military forces in areas of the national territory under control of the UNITA military forces, namely units consisting of Congolese citizens from the DRC and units composed of citizens of the DRC and of Rwanda of Tutsi-Banyamulenge and Hutu origin, and the need to proceed to their urgent repatriation.

1.2. In this regard, the General Staff of FAA, in close cooperation with the High General Staff of the UNITA military forces and with the participation of the Mixed Military Commission and support from the United Nations, will proceed to quarter and disarm the foreign military forces under the orders of the UNITA military forces, including the following:

a) The reporting, by the High General Staff of the UNITA military forces, to the General Staff of FAA and to the Mixed Military Commission, of all reliable and verifiable data, pertaining to the combat and numerical composition and location of the units of the foreign military forces in the areas still under their command.

b) The identification of the units of foreign military forces under the orders of the UNITA military forces.

c) The movement of personnel of the foreign military forces to the quartering areas of the UNITA military forces.

d) The welcome, accommodation and feeding, and also the registration of the personnel of the foreign military forces in the quartering areas.

e) The disarming, collection and storage of all armament and military equipment of the foreign military forces in the quartering areas.

f) The handing over of the members of the foreign military forces to the United Nations, for purposes of repatriation of the same to their countries of origin, namely the DRC and the Republic of Rwanda.

ANNEX 2: to the Memorandum of Understanding Addendum to the Lusaka Protocol for the Cessation of Hostilities and the Resolution of the Outstanding Military Issues under the Lusaka Protocol

Document pertaining to the integration of Generals, Senior Officers, Captains and Junior Officers, Sergeants and men from the UNITA Military Forces into the Angolan Armed Forces in accordance with the existing vacancies

The Delegation of the Angolan Armed Forces and the Delegation of the UNITA military forces, in the matter of the integration of Generals, Senior Officers, Captains and Junior Officers, Sergeants and men from the UNITA military forces into the FAA, in accordance with the existing vacancies, have agreed as follows:

1. The integration of the personnel from the UNITA military forces based on the principle of global incorporation and, in continuation, the incorporation of Generals, Senior Officers, Captains and Junior Officers, Sergeants and men and the subsequent demobilization and vocational reinsertion of the remaining personnel.

2. The designation of Generals, Senior Officers, Captains and Junior Officers, Sergeants and men from the UNITA military forces for integration into FAA is the responsibility of the High General Staff of the UNITA Military Forces.

The Delegation of the Angolan Armed Forces and the Delegation of the UNITA Military Forces to the Military Talks, in the matter related to the integration of Generals and Senior Officers from the UNITA military forces into the National Police, according to the existing vacancies, have agreed as follows:

1. The designation of Generals and Senior Officers from the UNITA military forces for integration into the National Police shall be the responsibility of the High General Staff of the UNITA military forces.

2. The incorporation into the National Police and the commissioning of the Sub-Commissioners and Senior Officers, shall be the responsibility of the General Command of the National Police, in accordance with the staffing list of the National Police, described below:
